TERMS AND CONDITIONS

- DESIGN IN BOX (part of VDS INBUCO B.V.)

These are our general terms and conditions. They, together with the references they contain, apply to every offer, quotation and agreement we, Design in Box (with Chamber of Commerce number: 11056396), make with you.

You can also reach us at our telephone number +31(0) 34 57 45 444. We have the right to change these terms and conditions. You agree that the latest version of these general terms and conditions will always apply to our agreement.

Article 1 - Products

  1. We sell furniture and home accessories (such as dining room tables, chairs, sofas and lamps) through our web shop at www.designinbox.nl, by phone and in our physical showroom/store.
  2. All images, specifications and other data about the products are indicative. Design in Box cannot guarantee that the colors displayed will exactly match the actual colors of the products.
  3. Some products are custom made and therefore may vary. We are not responsible for any inaccuracies on our website about designs, photos and other information about a product.
  4. All offers and quotations from Design in Box are without obligation. An offer consists of a description of a product and services.

Article 2 - Orders

  1. If you place an order through the webshop, you need to enter your details (name and address details). You also provide your details when purchasing from us in the showroom. You are responsible for the accuracy of these details.
  2. After you place an order, Design in Box will send an email confirmation of it.
  3. You can change the ordered product within 24 hours of receiving the order confirmation.
  4. Design in Box may refuse a request for modification of a product if it may affect the work qualitatively or quantitatively (such as modification of a custom-made product).

Article 3 - Payments

  1. The (total) price including VAT of the products is indicated in our webshop and physical showroom. After products are ordered, their prices are not increased.
  2. An order requires a down payment in the amount of 25% of the total amount (including VAT). Orders from stock must be paid in full in advance. If you place an order by phone or e-mail, you can pay the down payment by bank transfer. If you place an order in our showroom, you can pay the down payment by debit card or bank transfer. The remaining amount can be paid by bank transfer prior to delivery or by PIN card when delivering or picking up the products.
  3. If you act from profession or company and make a business order within the Netherlands or Belgium, you must pay 50% in advance. The remaining amount will be transferred by bank transfer after delivery.
  4. In case of non-payment by the customer, subject to legal restrictions, the entrepreneur has the right to charge the reasonable costs made known to the consumer in advance.
  5. You can pay in our webshop with iDEAL and via credit card.

Article 4 - Deliveries

  1. You can pick up the product in Culemborg at the address Beesdseweg 11, 4107LV or have it delivered. Costs for delivery are indicated on the website. Possible assembly is possible and the costs are indicated on the website.
  2. We will deliver your product to the address you provided when you placed the order. You cannot change the address once we have already shipped the package.
  3. Our products are often heavy, and are therefore transported and brought in by two people if necessary. When a product is heavy, conditions at the delivery location may prevent the delivery drivers from reasonably getting the product inside. These conditions should be optimized as much as possible by you, the customer.
  4. Make sure that all possible obstacles, which may hinder the transportation of your goods are removed (cabinets, paintings, lamps, etc.). Also cover vulnerable floors, walls and passages and/or alert our driver to the vulnerability.
  5. Design in Box is not liable for damage from transportation from the first door/first entrance. However, we are happy to help you place the product inside.
  6. You must be present during delivery for products to be assembled, otherwise we will charge a cancellation fee (€50).
  7. If a product cannot go inside and other means of transportation (hoist or moving elevator) must be used, this is entirely at your expense and risk.
  8. Design in Box and transport partners thereof have the right to abort a delivery if the driver indicates that the delivery or assembly situation is irresponsible. Transportation costs and any additional costs are at your expense.
  9. Delivery may take place outside the given time frame due to traffic conditions or other unexpected developments.
  10. If you are not satisfied with the way the products were transported, assembled or delivered, please contact Design in Box at klantenservice@designinbox.nl or by calling +31(0) 34 57 45 444.
  11. The delivery times in the order confirmation are indicative. We will do our best to deliver the order promptly. If the order is delayed, we will notify you in writing. We guarantee that you will receive the order no later than 150 days after order confirmation. In the unlikely event this does not succeed, you may request us to (a) refund the amount you paid for the product immediately, or (b) send you a replacement product (of equal value).

Article 5 - Modification of Delivery Date.

You can change the scheduled delivery date of the order at klantenservice@designinbox.nl. If you wish to change the date within 24 hours before the scheduled delivery date, you must pay a cancellation fee in the amount of €50 (incl. VAT).

Article 6 - Return

  1. If you as a consumer have ordered a stock item through the webshop, you may return the product within 14 days after you have received it. You can do this by sending an e-mail to klantenservice@designinbox.nl. After you have received a confirmation from us, you must send the product within 14 days. Once we have received the product, we will refund the full purchase price within 14 days. You will be responsible for the cost of return shipping. During the time you have to consider whether to keep the product, you must handle the product and its packaging carefully. You may only unpack and use the product to the extent necessary to determine whether you want to keep the product. Thus, you should always return the product in its original undamaged packaging. This does not apply to custom-made products as described in paragraph 2.
  2. Out-of-stock products that are custom made to your specifications (such as desired size and color) cannot be returned.

Article 7 - Warranties

  1. Design in Box guarantees that the products meet the usual requirements and standards that can be set at the time of delivery. Complaints about material or production errors will of course be dealt with.
  2. You have a 12-month warranty on products provided all usage and maintenance instructions have been followed and carried out.
  3. The warranty does not apply if the product is misused.
  4. The warranty also does not apply if a defect occurs due to circumstances beyond Design in Box's control.
  5. A lacquered frame or stained table top will wear out through normal use, this is not a reason for complaint.
  6. Excluded from warranty are scratches in the lacquer or tears or cracks in the panel itself. Even with normal use, a lacquered or stained tabletop can have scratches and cracks in the lacquer finish. These damages to edges and surface are not part of the warranty because they are inherent to a lacquer finish.
  7. A crack in a solid wood product is caused by dryness in the room where it stands. Wood is a natural product. If it becomes too dry in the room then the wood also becomes drier and cracks. If the weather is more humid in the room then wood attracts moisture and does not crack. Relative humidity fluctuates greatly under the influence of such things as weather, heating and insulation. It is the customer's responsibility to keep the humidity in the room where the furniture is placed constantly around 65%, at least between 50 and 70%, for example by means of dehumidifiers.

Article 8 - Retention of title.

Ownership of the products passes to you only after the entire amount has been paid by you.

Article 9 - Liability

  1. We are not liable for incorrect product information on the website or the damage caused by use of a product. This does not apply if such damage was caused by our intentional, gross negligence or deliberate recklessness. In any case, your right to compensation will be a maximum of the amount of the product ordered and paid for.
  2. When using the product outside the Netherlands, you must verify yourself whether the products are suitable for use in the country in question and whether the products meet the conditions and (legal) requirements imposed on them.

Article 10 - Intellectual property rights

All intellectual property rights (such as: copyrights, logos, word marks) in our texts, photos, images and other materials, are our property (or are under our control with the permission of the rights holder). Your use should not infringe upon them.

Article 11 - Force majeure

  1. Design in Box does not have to fulfill its obligations in the event of force majeure.
  2. Design in Box may suspend the obligations under the agreement during the period of force majeure. If this period lasts longer than 3 months then both parties may dissolve the agreement without being obliged to pay damages.

Article 12 - Complaints procedure

  1. If you have a complaint about the execution of the agreement, we would like to hear about it. Please send your complaint as soon as possible (and as fully described as possible) to info@designinbox.nl. We will handle your complaint as soon as possible, at the latest within five days after we receive your complaint. If it takes longer to settle the complaint, you will receive confirmation of your complaint within five days and we will let you know when we expect a substantive response. If we cannot resolve the complaint among ourselves, a dispute will arise under the dispute resolution process.
  2. If it is established that an item is defective and this has been reported in time, Design in Box will replace, repair or compensate you for the defective item within a reasonable period of time after written notification of the defect by you. If you report a complaint later than 30 days after delivery, you are no longer entitled to repair, replacement or compensation.

Article 13 - Dispute resolution

These general terms and conditions and the agreements we enter into with you are governed by Dutch law to the exclusion of the Vienna Sales Convention. In the event of a dispute the court in Amsterdam shall have jurisdiction.
